The Energy Regulatory Commission is composed of a President and 6 members in the commission who are officials elected by the Parliament of the Republic of North Macedonia and its Service for Professional and Administrative Operations. The internal organization and systematization of jobs and tasks are regulated by a special rulebooks of the Energy Regulatory Commission. The Rulebook on Internal Organisation and Rulebook of systematisation of jobs and tasks of the Energy Regulatory Commission define its organizational units, temporary and permanent workgroups, and the total number of staff in sectors and services. In such a manner, the implementation of professional and administrative & technical operation in the Energy Regulatory Commission is organized in:
- sectors and services, in the capacity of permanent organizational units; and
- temporary workgroups that implement individual-specific operations and tasks which fall under the competence of the Energy Regulatory Commission, but which require a multi-sector approach.
According to the Rulebook on Internal Organisation, the following are the organizational units for the implementation of professional operations for the purposes of the Energy Regulation Commission:
- Electricity Department;
- Natural Gas, Liquid Fuels and District Heating Department;
- Economic Department;
- Legal Department;
- Monitoring, Investigations, and Misdemeanor Department;
- Water Services Department;
- Human Resources, Logistics, Finance and General Affairs Department; and
- Department for Information Technology and Statistics
The operations of a particular sector are headed by a Head of the Sector, whereas the operations of the service are headed by the Head of the Service. Heads of sectors and the head of the service are in charge of organizing and implementing the work of the sectors and the service, for which they report to the Energy Regulatory Commission.
The Internal Organization of the Energy Regulatory Commission envisages working posts exempted within the sectors (organizational units), but are of immediate connection to the work of the President and the members of the Energy Regulatory Commission, and are listed below:
1. Advisor to the President and members of the Energy Regulatory Commission on Legal Affairs
2. Advisor to the President and members of the Energy Regulatory Commission on Economic Affairs
3. Advisor to the President and members of the Energy Regulatory Commission on Electricity
4. Advisor to the President and members of the Energy Regulatory Commission on Natural Gas, Liquid Fuels and District heating, and
5. Advisor to the President and members of the Energy Regulatory Commission on Administrative affairs and Finance
6. Internal Auditor.
ELECTRICITY DEPARTMENT
The Sector for Technical & Energy Operations in the Field of Electricity implements the following operations for the purposes of the Energy Regulatory Commission:
- monitors the functioning of the electricity market;
- takes care for the improvement and the protection of the rights of electricity consumers;
- participates in the drafting of regulations, pricing decisions and license issuance in the field of electricity;
- monitors the fulfillment of obligations upon the issuance of licenses in the field of electricity;
- takes part in and makes proposals in resolving the conflicts arising between service providers and beneficiaries in the field of electricity;
- cooperates with the competent national authorities, local government bodies, trade companies executing energy-relating activities and service beneficiaries in the field of electricity; and
- participates inadequate work groups belonging to regional and international organizations.
NATURAL GAS, LIQUID FUELS AND DISTRICT HEATING ENERGY
The Sector for Technical & Energy Operations in the Field of Natural Gas, Liquid Fuels and Heat Energy implements the following operations for the purposes of the Energy Regulatory Commission:
- monitors the functioning of the natural gas, liquid fuels and heat energy market;
- takes care for the improvement and the protection of the rights of natural gas, liquid fuels and heat energy consumers;
- participates in the drafting of regulations, pricing decisions, and license issuance in the field of natural gas, liquid fuels and heat energy;
- monitors the fulfillment of obligations upon the issuance of licenses in the field of natural gas, liquid fuels and heat energy;
- takes part in and makes proposals in resolving the conflicts arising between service providers and beneficiaries in the field of natural gas, liquid fuels and heat energy;
- cooperates with the competent national authorities, local government bodies, trade companies executing energy-relating activities and service beneficiaries in the field of natural gas, liquid fuels and heat energy; and
- participates inadequate work groups belonging to regional and international organizations.
ECONOMIC DEPARTMENT
The Sector for Economic Affairs implements the operations relating to the monitoring of the situation with the energy market in the Republic of NorthMacedonia and internationally; analysis of the economic status of energy-related activities; study of the financial situation of the energy-relating entities; monitoring of the energy price variations; application of methodologies and tariff systems for the pricing of particular kinds of energy; analysis of requests for price modifications submitted to particular energy-relating entities; and other operations for the purposes of the Energy Regulatory Commission.
LEGAL DEPARTMENT
The Sector for Legal Affairs implements the following operations:
- prepares all the regulations and other general and special legislative acts that are to be adopted by the Energy Regulatory Commission;
- drafts the legal positions for the purposes of the Energy Regulatory Commission;
- follows the legislation of the Republic of North Macedonia and EU and informs the Energy Regulatory Commission about the need to draft new regulations compliant with the amended legislation and indicates to the Energy Regulatory Commission about the need to start an amending procedure for the existing legislation in the Republic of North Macedonia;
- participates in conflict resolution;
- starts and participates in the procedures for protection and improvement of the rights of energy consumers; and
- carries out other operations for the purposes of the Energy Regulatory Commission.
ADMINISTRATIVE & TECHNICAL SERVICE
The Administrative & Technical Service implements all the work pertaining to the administrative and technical support for the operation of the Energy Regulatory Commission.
Permanent and Temporary Work Groups
The permanent and temporary workgroups are formed for the purposes of implementing the operations pertaining to the scope of competencies of the Energy Regulatory Commission. The permanent workgroups are formed for the implementation of operations relating to:
- issuance of licenses and monitoring of their implementation;
- pricing and tariffs; and
- participation in conflict resolution and proposal of measures to resolve the conflicts.
- Temporary workgroups are formed to implement operations of a temporary character, such as relating to:
- drafting of rules and regulations that are under the competence of the Energy Regulatory Commission;
- providing opinions on particular issues;
- implementing the operations deriving from international obligations; and
- drafting proposals on procedures for individual specific issues under the competence of the Energy Regulatory Commission.
The establishment of the workgroups is done by way of Resolution by the Energy Regulatory Commission which thereby defines the tasks, scope of operation, composition, and the Head. The operations of workgroups are headed by a Head appointed by the Energy Regulatory Commission. The temporary workgroups are headed by one of the existing Heads of Sectors, depending on the closeness of the specific tasks to the operations regularly implemented in the corresponding sector. The permanent workgroups are headed, as a rule, are headed by one of the Heads of Sectors, depending on the specific task for which the workgroup has been formed:
- for license issuance and monitoring of license implementation – Head of the Sector for Technical & Energy Operations;
- pricing and tariffs – Head of the Sector for Economic Affairs; and
- participation in conflict resolution and proposing measures for conflict resolution – Head of the Sector for Legal Affairs.
- Staff members in the specific sectors of the Energy Regulatory Commission are also appointed as part of the composition of permanent and temporary workgroups.
